Chain Lakes Power Would Pay $39,500 to Settle PUCT Staff Compliance Audit

Chain Lakes Power Company, L.P., would pay $39,500 under a settlement with PUCT Staff to resolve allegations that Chain Lakes Power was not in full compliance with 26 provisions of the Substantive Rules (39460).
The allegations resulted from a Staff compliance audit.
Specifically, Staff alleged that Chain Lakes Power, formerly d/b/a Simple Power, was not in full compliance with the following:
- P.U.C. SUBST. R. 25.474(d)(5)(F) & 25.474(h)(4)(E) relating to enrollment. Staff alleged that the presence or absence of early termination charges was omitted
- P.U.C. SUBST. R. 25.474(h)(4)(H) relating to telephonic enrollment. Staff alleged that the customer's right of rescission was not disclosed
- P.U.C. SUBST. R. 25.475(d)(2)(C) relating to changes in contract and price and notice of changes. Staff alleged that bills did not include a statement about how to obtain information about the price that will apply on the next bill
- P.U.C. SUBST. R. 25.475(g)(2)(f)(iii) relating to electricity facts label. Staff alleged that the prescribed statement regarding price was omitted
- P.U.C. SUBST. R. 25.479(c)(1)(Q) relating to bill content. Staff alleged that the notification of price change was omitted
Staff reported that, "[s]ince receiving the results of the Commission's compliance audit which form the basis of the settlement agreement, Company has consummated the sale and transfer of all of its customers to another retail electric provider, effective May 9, 2011. This event has obviated the need for corrective actions by Company at this time". (see story regarding sale)
