Enron Energy Texas Files Amended Application For Texas Retail Provider Certificate

While EnergyChoiceMatters.com typically does not cover routine or administrative developments in retail supplier licensing proceedings, because of intense reader interest in the Texas REP application of Enron Energy Texas LLC ("Enron"), ECM provides the following update for those counting the days since the initial application.
Enron Energy Texas LLC on April 23 filed an amended application for an Option 1 Texas retail electric provider certificate
The amended filing follows a PUC Staff determination that prior filings were deficient for the purpose of reviewing the application. Such PUC Staff finding did not address the merits of Enron's application, but rather addressed whether all materials needed for review had been filed
The April 23 amended filing from Enron is most noteworthy in that, to the extent the filing is found to be sufficient for review, the clock will commence on a Commission determination concerning REP certification. See a discussion of the REP certification timeline in our prior story here
In the amended filing, Enron no longer seeks, as part of the initial REP certification, to collect customer deposits or prepayments
The amended filing also includes information which PUC Staff had stated was not included in prior filings, including the identification of a third-party QSE and other vendors on which Enron will rely to meet certain of the REP certification requirements
The amended filing also now includes the customary D-6 attachment in which Charles Gaydos, CEO of Enron Energy Texas LLC, affirms that neither Enron Energy Texas LLC, nor any executive officer, control person, or principal of Enron Energy Texas LLC, has been
convicted or found liable for fraud, theft, larceny, deceit, or violations of any securities laws,
customer protection laws, or deceptive trade laws in any state.
