ERCOT To License Patents From Affiliate Of Texas REP To Facilitate Controllable Load Resources

On April 10, 2025, ERCOT entered into an agreement with Lancium LLC to license certain of Lancium's patents at no cost.

Lancium stated, "The license, provided at no expense to ERCOT, addresses potential intellectual property barriers that may have previously limited the engagement of controllable load resources, and others, in the market. The arrangement, developed collaboratively, ensures ERCOT can sublicense these patents freely, thereby expanding market participation opportunities without risk of patent infringement disputes."

Among other things, Lancium operates an Option 2 retail electric provider, Lancium QSE I, LLC

Patents included within the license include all of Lancium's U.S. patents, whether existing or which may be issued from subsequent Lancium patent applications, that are potentially applicable to Load Resources' registration as Controllable Load Resources (CLRs) and their provision of Ancillary Services in the ERCOT Region

The Agreement states that ERCOT had sought the licenses in order to allow Resources to freely register and participate as Controllable Load Resources in ERCOT or to provide Ancillary Services in ERCOT

"ERCOT has entered into a licensing agreement with Lancium LLC to license certain of Lancium’s U.S. patents at no cost in order to ensure that entities registered with ERCOT as Controllable Load Resources (CLRs) are able to participate in the ERCOT market and provide Ancillary Services without being subject to allegations of infringement of Lancium’s patents," ERCOT said

"ERCOT has taken action to deem all entities that register as CLRs to be sublicensees to that license; no further action by CLR registrants is required," ERCOT said

"The license allows ERCOT and any sublicensees to: (i) make, have made, use, sell, offer for sale, import, or otherwise distribute any products (including software) and services that would otherwise infringe the licensed patents, and (ii) practice any methods, processes, and procedures that would otherwise infringe the licensed patents," ERCOT said

The agreement with ERCOT states that Lancium, "wishes to provide goodwill and increase market participation in certain ERCOT programs in the Licensed Territory [ERCOT] by providing to ERCOT a license to and under the Licensed Patents."

Among other things, such patents address:

• Method and System for Dynamic Power Delivery to a Flexible Datacenter Using Unutilized Energy Sources

• Methods and Systems for Adjusting Power Consumption Based on Dynamic Power Option Agreement

• Providing computational resource availability based on power-generation signals

• Redundant Flexible Datacenter Workload Scheduling

• System of Critical Datacenters and Behind-the-Meter Flexible Datacenters

• Granular Power Ramping

• Computing Component Arrangement Based on Ramping Capabilities

• Systems and methods for auxiliary power management of behind-the-meter power loads
