Texas ALJ Dismisses Final Uri Pass-through Complaint

A Texas State Office of Administrative Hearings ALJ dismissed the remaining complaint pending before the Texas PUC concerning MidAmerican Energy Services LLC's imposition of a supplemental ancillary service charge after Winter Storm Uri

Certain customers in various cases had filed formal complaints with the Texas PUC alleging that the supplemental A/S charge was in violation of their electricity supply contracts with MidAmerican. MidAmerican argued that the adjustment was permissible. Previously, all but one complaint at the Texas PUC against MidAmerican concerning the supplemental ancillary service charge had either been settled, withdrawn, and/or dismissed, with no precedential findings or orders from the PUC

The sole remaining complaint had been filed by Tuesday Morning Inc., which as previously reported is undergoing liquidation under Chapter 7.

The ALJ had imposed a deadline for Tuesday Morning to respond to show why the complaint should not be dismissed for failure to prosecute

Tuesday Morning did not file a response

The ALJ dismissed the complaint from Tuesday Morning from SOAH and from the PUC, without prejudice
