PSC Denies Retail Supplier's Request To Relinquish License

The Maryland PSC denied, without prejudice, a request from Great American Power, LLC to relinquish Great American Power's electric license, following an earlier assignment of Great American Power's Maryland customers to Powervine Energy

The PSC's denial was based on potential ongoing liability associated with Great American Power's activities prior to the assignment and any withdrawal of the license

Great American Power has only one non-closed customer complaint before the PSC's Consumer Affairs Division (CAD), though the PSC recognized that such customer has been provided a refund. Still, the PSC noted that the complaint has not been formally closed (and whether Great American Power has waived an appeal of any CAD determination is unclear due to the lack of a filing to such effect from Great American Power, see prior discussion here). The PSC directed Great American Power to file an update with the PSC once the complaint has been formally closed at CAD

Regardless of this specific "open" complaint, the PSC said that there remains potential for other matters to arise from Great American Power's prior activity, even if any potential issue has not yet been raised. Furthermore, the PSC noted that neither Great American Power nor Powervine has indicated which entity holds the responsibility for prior activity related to the assigned customers, which occurred prior to the assignment

As such, the PSC said that it must retain jurisdiction over Great American Power until the CAD complaint is formally closed and until it is clear which entity is responsible for any future complaints from the assigned customers related to activity prior to the assignment

Great American Power was directed to file with the PSC a copy of the assignment agreement between Great American Power and Powervine, which may potentially address the entity which is liable for any activity prior to the assignment

The PSC said that Great American Power may re-file its request to surrender its license upon the closing of the complaint identified above, and if Great American Power no longer has any liability associated with the assigned customers, due to such liability being assigned to Powervine under the assignment agreement
