PSC Commences Proceeding On Retail Supplier Marketing, Disclosure Language

Executing a directive under SB1, the Maryland PSC has opened a new proceeding to address various language to be used by retail energy suppliers in disclosures, and language which is prohibited in marketing

As previously reported, SB1 requires that, for residential electric and gas retail suppliers, the PSC may (permissive):

(1) require a residential retail energy supplier to post notices and disclosures required by law on the supplier's website:

(i) in a prominent location;

(ii) using at least a certain minimum font size; and

(iii) in a format approved by the PSC; and

(2) require or prohibit the use of specific language in a residential retail energy supplier's marketing materials, disclaimers, disclosures, and legal documents, including requiring or prohibiting the use of specific language based on service or product type.

In contrast, SB1 mandates that the PSC shall require residential retail suppliers to post on the supplier's website, in "clear and unambiguous language":

(A) the terms and conditions of the residential services and products sold by the retail supplier; and

(B) an environmental disclosure, in a format required by the PSC, for the residential services and products sold by the retail supplier.

The PSC convened Public Conference 68 (PC 68) to address these requirements and its discretionary authority, and invited stakeholder comment (comments due by February 14, 2025)
