New Texas Bill Filed To Order PUC To Develop Process To Procure "Emergency Reserve Power Generation Capacity"

A new Texas bill (HB 1603), authored by Rep. Jon Rosenthal, D, has been pre-filed that would require the Texas PUC to, "develop a process for
procuring emergency reserve power generation capacity ... as necessary to prevent blackout conditions caused by shortages of generated power in the ERCOT power region".
HB 1603 would provide that the "emergency reserve power generation capacity" shall be distinct from ancillary and reliability services procured under existing statute
The PUC would be required to establish, by rule, the, "parameters for estimating the amount of emergency
reserve power generation capacity necessary to prevent blackout
conditions."
The rules that would be required to be developed by the PUC would also be required to provide for "mechanisms" (plural) for, "equitably sharing the costs of
making the reserve capacity available and the costs of generated
power provided to prevent blackout conditions."
The bill would require ERCOT to enter into contracts for emergency reserve power generation capacity as needed in an amount as determined by the rule developed by the PUC
HB 1603 provides that ERCOT shall, "use all other sources of power and demand
reduction available," before dispatching the emergency reserve power generation capacity
