Texas ALJ Would Again Find Texas REPs Must Receive 45 Days Notice Of "Approved" New DCRF Rates

A Texas ALJ has further affirmed that Texas retail electric providers must receive 45 days notice of new Distribution Cost Recovery Factor (DCRF) rates once they are approved by the PUC before the new rates can take effect, and that this notice period cannot begin sooner by using proposed rates

The PUC had already addressed this question earlier this year, agreeing with REPs that the 45 days of notice to REPs prior to a TDU's use of new DCRF rates must be 45 days from the date of approval of the new rates by the PUC. The notice period may not start earlier by using proposed, but not-yet-approved, rates. See story here

The PUC later affirmed this start date for the 45-day notice period in subsequent actions, including a recent October final order

An ALJ in a newly issued proposed order in AEP Texas' DCRF proceeding would agree that the notice to REPs that is required under statute must be notice of the, "ultimately-approved DCRF rates".

As such, the proposed decision would provide that AEP Texas' new DCRF rates shall be effective on and after AEP Texas' provision of 45 days notice of the "approved rates" to REPs
