Texas PUC Adopts Rule For Registration Of Crypto Miners

The Texas PUC adopted a final rule that requires certain cryptocurrency miners and similar operations to register with the Texas PUC
Under the final rule, a "person" (which under Texas law generally includes businesses organized under various typical forms) operating a "virtual currency mining facility" in ERCOT shall register with the PUC as a large flexible load if the facility requires a total load of more than 75 MW and the facility’s interruptible load equals 10 percent or more of the actual or anticipated annual peak demand of the facility.
For existing crypto miners, the registration deadline is February 1, 2025.
New facilities are required to register one working day after the facility starts receiving retail electric service
Consistent with a previously reported Staff recommendation, the PUC declined to require that retail electric providers must inform their customers who may be engaged in crypto mining, including any customers over a megawatt size threshold, of the new registration requirement
The final rule also does not require that REPs shall be provided a notice of a customer's filing of a crypto mining registration
Among other things, crypto miners under the registration will report the anticipated peak load, in MWs, from the facility for each year of the five-year period, and the percentage of the site load that meets the definition of interruptible load set forth in the rule
