Retail Supplier Receives Probable Non-Compliance Notice From PUC

Via Renewables, Inc. disclosed in a 10-Q that Major Energy, one of Via's retail suppliers, has received a notice of probable non-compliance from, as described by Via, the, "Public Utility Commission of Ohio" [sic]
"On August 14, 2024, the Public Utility Commission of Ohio ('PUCO') [sic] sent Major Energy a notice of probable non-compliance regarding approximately fifty-five consumer complaints during the time period January 3, 2023 through April 12, 2024," Via said in the 10-Q
"The Company is working cooperatively with PUCO to resolve this matter, provided its detailed response to the probable non-compliance on October 24, 2024, and believes this matter will not have a material impact on the Company," Via said in the 10-Q
No further information concerning the notice of probable non-compliance was disclosed in the 10-Q, such as the subject matter of the complaints
Though Via in the 10-Q described the notice as from the "Public Utility Commission of Ohio", typically such notices are more precisely described as being issued by PUCO Staff, rather than the Commission (as such notices are not formal findings and do not represent Commission action; it is presumed here that the notice referenced in the 10-Q was from PUCO Staff as is customary and that Via's description was colloquial; also, PUCO's name is the Public Utilities [plural] Commission of Ohio)
Notices of probable non-compliance are typically not made public until either a settlement is filed between the respondent and PUCO Staff, or PUCO Staff seeks from the Commission the initiation of a formal investigation after Staff first engages with the respondent informally through the notice letter and subsequent discussions
