Large Municipal Aggregator Withdraws Application For "Power Broker" License

The Southeast Ohio Public Energy Council, which runs a large opt-out municipal aggregation in Ohio, has withdrawn its application for an Ohio electricity power broker license
SOPEC's withdrawal was without prejudice to re-filing an application in the future.
An ALJ at the PUC of Ohio had recently suspended the automatic approval process in reviewing SOPEC's broker application, though, as is common in such suspensions, the ALJ's directive did not specify the reason for the suspension of the automatic approval process, other than, generally, stating that the suspension would provide for additional time for review by PUCO and PUCO Staff
In many cases, though typically not made explicit in the relevant suspension orders, a suspension is ordered when more or clarified information is requested from the applicant, and the suspension reflects largely procedural or filing issues. In other cases, a suspension may be issued for a more substantive reason, and does not reflect a lack of complete information filed by the applicant, but rather that there may be material issues regarding the application that need more time to be digested by PUCO. ECM stresses that the reason for the suspension in the SOPEC application review was not stated, and is thus unknown
SOPEC, which also uses the name Sustainable Ohio Public Energy Council, serves as a municipal aggregator for 29 Ohio communities, including Dayton and Cleveland
As first reported by EnergyChoiceMatters.com, SOPEC in its application selected only the box for certification as a broker. SOPEC had said in its application that it would, "operate only as an aggregator and power broker." SOPEC is currently certified as a governmental aggregator (which is a separate certification from an "aggregator")
SOPEC has said that it would not take title to the power.
SOPEC had also previously stated in the application that, "SOPEC’s operations will include generation of power for retail sales, the scheduling of retail power for transmission and delivery, the provision of retail ancillary services, and other services used to arrange for the purchase and delivery of electricity to retail customers."
SOPEC had sought the power broker license to serve all customer classes in all service areas
