Broker Said To Cease Use Of Name Which Had Included "NRG"

In a filing with the Pennsylvania PUC, NRG Energy, Inc. averred that Integrity NRG Services of Pennsylvania LLC, a broker applicant which has no affiliation with NRG Energy, Inc., has told NRG Energy, Inc. that Integrity NRG Services of Pennsylvania LLC is no longer using the name "Integrity NRG Services of Pennsylvania LLC"
The broker applications of Integrity NRG Services of Pennsylvania LLC had been first reported by EnergyChoiceMatters.com (see background here)
Integrity NRG Services of Pennsylvania LLC had filed applications for Pennsylvania electricity and natural gas broker/marketer licenses to serve all customer classes in all service areas
Specifically, NRG Energy, Inc. averred that Integrity NRG Services of Pennsylvania LLC has informed NRG Energy, Inc. that, as stated by NRG Energy, Inc., "Integrity [NRG Services of Pennsylvania LLC] has indicated that (1) it is no longer using the name 'Integrity NRG Services of Pennsylvania LLC' in Pennsylvania; (2) it will desist from using 'NRG' in its name in this and any and all future registrations; and (3) it will phase out the use of 'NRG' in its internet domain name."

NRG Energy, Inc. said that, in light of such commitment from Integrity NRG Services of Pennsylvania LLC, the PUC should not approve Integrity NRG Services of Pennsylvania LLC's electric and gas broker applications in their current forms
NRG Energy, Inc. noted that the broker applications from Integrity NRG Services of Pennsylvania LLC only included the name Integrity NRG Services of Pennsylvania LLC as the name under which the broker would operate, with no fictitious name listed in response to a question on the application forms regarding the use of a fictitious name. (As noted in our prior story, several appendices to the applications refer to Integrity Energy Services LLC, but such name was not formally listed as a fictitious name)
NRG Energy, Inc. filed protests of the broker applications of Integrity NRG Services of Pennsylvania LLC to ensure that Integrity NRG Services of Pennsylvania LLC, "may not use NRG’s [NRG Energy, Inc.] legal name in any marketing, advertising, trademark or other customer-facing communications in Pennsylvania," with NRG Energy, Inc. alleging that, "such use would be misleading and cause significant customer confusion."
NRG Energy, Inc. said that the PUC's grant of any license to Integrity NRG Services of Pennsylvania LLC should include the conditions that: (1) Integrity NRG Services of Pennsylvania LLC shall to re-file each broker application to remove "NRG" from the broker's name; and (2) Integrity NRG Services of Pennsylvania LLC shall demonstrate, within 6 months, that it has updated the broker's domain name and email address to remove any reference to "NRG"
