Texas REP Receives Authority From PUC To Use Trade Name Energy Texas

The Texas PUC has granted Rhythm Ops, LLC an amended retail electric provider certificate to include the trade name Energy Texas on the certificate
Through an administrative approval of Rhythm's uncontested amendment application, the PUC found that the trade name Energy Texas is not duplicative of a name previously approved for use by an "existing" REP certificate holder
As previously reported, an ALJ had requested that parties brief the question of applying the REP certificate rule which, among other things, provides that a REP's name shall not have been "previously approved" for use by "a" REP certificate holder (as opposed to an "existing" REP)
The Energy Texas trade name was previously approved for use by Declaration Energy, but Declaration Energy has relinquished the trade name at both the PUC and Texas Secretary of State, and Rhythm acquired the Energy Texas trade name through a brand assets acquisition
The PUC's notice of approval for Rhythm's amended certificate did not substantively address this issue, other than noting that the Energy Texas name is not duplicative of a name previously approved for use by an "existing" REP certificate holder
The administrative approval has no precedential value in a future proceeding
