Reduction In Texas Retail Providers Seeking To Serve As Volunteer POLRs

Only one Texas retail electric provider is seeking to serve as a volunteer provider of last resort in Texas for the 2025-2026 term.

Specifically, per a PUC Staff report, TXU Energy Retail Company LLC is the only REP that has filed to serve as a volunteer POLR for 2025-2026

TXU sought volunteer POLR status for residential and small non-residential customers in all applicable service areas (LPL has its own separate POLR process), and for medium non-residential customers in all service areas except AEP Texas North. These are the same service areas for which TXU currently serves as a volunteer POLR

Under the current term, Reliant serves as a volunteer POLR for residential and small non-residential customers in all service areas, but Reliant has not sought to continue such status for 2025/2026, according to a PUC Staff report

Staff also posted a preliminary list of all REPs eligible, based meeting a sales volume threshold and other criteria set in rule, to serve as a non-volunteer POLR (called Large Service Providers or LSPs) for each customer class and service area (excluding LP&L which has its own process) for the 2025-26 term.

REPs identified as eligible to be assigned non-volunteer POLR responsibility may challenge Staff's preliminary determination through September 6, 2024

After a review of any such challenges, Staff will designate up to 15 non-volunteer POLRs for each customer class in each service area. This will reflect the 15 (or fewer) REPs with the greatest market share for such customer group and service area which meet the minimum non-volunteer POLR threshold eligibility requirements
