Texas PUC Issues Proposed Rule For Retail Provider Demand Response Programs, Funding

The Texas PUC on August 29 formally issued a proposal for publication to implement a goal for an average total residential load reduction in the ERCOT market, with REPs authorized to secure funding from the ratepayer-funded energy efficiency programs to achieve the goal

In issuing a proposal for publication, the PUC adopted Staff's draft language without substantive changes to Staff's previously reported language, except that the PUC added language that would provide authority for the PUC to seek information from REPs relating to the residential load reduction goal, and REPs' smart device programs (noted below) developed thereunder

As previously reported, Texas PUC Commissioner Courtney Hjaltman sought the addition of such language giving the Commission the authority to seek relevant information from REPs

Specifically, the proposal for publication issued by the PUC provides that, "Commission staff may request additional data from REPs and ERCOT regarding the responsive device program under subsection (c) of this section and to assist in evaluating and revising the goal under subsection (d) of this section."

The proposed average total residential load reduction goal under subsection (d) is 0.25.

Under the referenced responsive device program under subsection (c), a REP may offer a program that offers an incentive to residential customers, with smart responsive appliances or devices, to reduce electricity consumption during an ERCOT peak demand period.

The term smart responsive appliance or device is defined as an appliance or device that allows its electricity usage (or the usage of connected devices) to be adjusted remotely

The draft rule would allow a REP to receive funding for a responsive device program through an energy efficiency incentive program established by statute, provided that the REP's program meets the evaluation, measurement, and verification requirements of the incentive program

A TDU would be permitted to use up to 10% of its energy efficiency budget for the REP responsive device programs described above
