Texas PUC Staff Endorse Target, Not Mandatory, Reliability Standard

Texas PUC Staff have endorsed use of a reliability standard being developed by the PUC as a target, rather than a mandated level
Staff said that language in a pending proposal for publication sets the reliability standard as a target that the Commission may use in considering market performance and assessments from ERCOT to determine if the market design has provided sufficient incentive to meet the reliability standard
Certain parties had argued that the reliability standard must be mandatory under statute
However, Staff said that, "Requiring the Commission to take immediate action to address any deficiency revealed by ERCOT’s assessment, absent allowing for the Commission to consider the potential cost-benefit implications, is not consistent with the requirements in statute to balance reliability and cost."
"Staff believes that the PFP [proposal for publication] language provides the best balance of establishing a reliability standard and providing the Commission with options to address any real or assessed deficiencies," Staff said
