Texas REP Files To Transfer Certificate To Cure Prohibited Generation Ownership

Dow Pipeline, LLC filed for an amendment to an Option 2 Texas retail electric provider certificate currently held by an affiliate in order to transfer the REP certificate such that it is not owned by an entity which owns power generation in Texas

The relevant REP certificate, Number 10082, is currently held by Dow Hydrocarbons and Resources, LLC

Dow Pipeline, LLC reported that, as part of an internal reorganization completed on November 1, 2023, certain Texas generating facilities were transferred to Dow Hydrocarbons and Resources, LLC (the PGC and self-generator registrations for such generating units are contemporaneously being updated, Dow Pipeline said)

16 TAC § 25.5(114) provides that a REP, "may not own or operate generation assets."

Dow Pipeline, LLC filed the amendment to transfer REP certificate 10082 to Dow Pipeline, LLC, which does not own Texas generation assets, from Dow Hydrocarbons and Resources, LLC
