Texas PUC Enforcement Staff Withdraw Petition For $128,000 Penalty Against Retail Provider

Staff of the Texas PUC have withdrawn a petition which had sought the imposition of a $128,000 penalty against Our Energy, LLC for alleged violations of reporting requirements and the deadlines to respond to PUC Staff inquiries
As previously reported by EnergyChoiceMatters.com, Our Energy, LLC sold its book of customers to Frontier Utilities in early 2021.
However, Our Energy, LLC maintained a REP certificate after the book sale, though Our Energy has not served any Texas customers since the 2021 book sale
Staff had alleged that Our Energy failed to file annual and semi-annual reports starting in 2022. The sought $128,000 fine reflected a penalty of between $200 to $500 for each day that the reports were not filed after the due dates, and $2,000 per each instance in which the REP allegedly failed to respond to Staff inquiries
As previously reported, in May 2024, Our Energy, LLC filed at the Texas PUC to relinquish its Option 1 retail electric provider certificate. Such relinquishment was granted on August 2
In withdrawing its sought enforcement action and proposed penalty, Staff said, "Because Our Energy is no longer certificated as a REP and the violations at issue in this proceeding are limited to REP reporting requirements, Commission Staff has elected not to further pursue enforcement in this case."
