New York PSC Grants Extension For Certain Brokers To File Letter Of Credit; Denies "Untimely" Requests

The Secretary of the New York PSC has granted a subset of registering brokers/consultants an extension to file a letter of credit with the PSC as part of such brokers/consultants' registration with the PSC

The Secretary specifically granted -- only to those entities who filed on or before July 29, 2024 a request for an extension of the deadline to file a letter of credit -- an extension until September 30, 2024 for the filing of the necessary letter of credit

The extension is limited to only the filing of the letter of credit and does not apply to other parts of the broker registration application, which must be filed by the existing deadline of July 31, 2024

Moreover, the Secretary specifically denied any requests for an extension, related to the letter of credit or any other part of the broker registration, which were filed after July 29, 2024

The Secretary said that such requests filed after July 29, 2024 were denied as "untimely".

The Secretary cited the PSC's broker regulation order as providing that any request for an extension must be filed at least three days prior to the affected deadline (in this case, the relevant deadline was July 31, 2024)

The Secretary noted that 42 entities had filed a request for an extension for the submission of an LOC.

As of the issuance of the Secretarial letter, 18 of these requests were filed after July 29, 2024, and, as such, were denied.

It appears that 24 of the entities submitting an LOC extension request did so on or before July 29, 2024 and as such were granted an extension until September 30, 2024 for the filing of the requisite letter of credit
