Update: Regulator Formally Re-Files Proposed Retail Supplier Licensing Rules, Had Removed Proposed Rule Language Requiring Retail Suppliers To Publicly Post All Rates

The Connecticut PURA has now formally re-filed with the state's Legislative Regulation Review Committee (LRRC) PURA's updated proposal for revised retail electric supplier licensing rules

As detailed in an exclusive analysis by EnergyChoiceMatters.com last month, PURA revised the proposed supplier licensing rules in response to a rejection of the rules, without prejudice, by LRRC.

PURA's re-filing includes a narrative description of how PURA addressed each of LRRC's stated issues in rejecting the rules, but such narratives were generally more literal in nature in describing the textual changes, rather than providing insight into PURA's reasoning for its chosen language

As more fully described in our prior story, PURA has removed from the proposed rule the obligations for retail suppliers to post generally available offers to the state's rate board, and to include generally available offers on the supplier's own website. Note that while such an obligation may be removed from inclusion in the proposed rule, suppliers may continue to be subject to certain posting requirements for generally available offers under various PURA orders and directives.

As previously reported, while the latest PURA proposal retains the potential for PURA to require up to $2 million in licensing security from a supplier (RPS security remains a separate, distinct obligation), and the potential to increase an individual supplier's licensing security beyond $2 million at PURA's discretion, PURA cannot under the revised proposal change the level of security required for any of the four delineated volume-based security tiers set in the rule, absent a rulemaking process. The original proposal had suggested that PURA could have increased the security required under each volumetric tier without needing to conduct a rulemaking.
