Texas Retail Provider Objects To Broker's Name, Urges Rejection Of PUC Registration If Name Not Changed

Young Energy, LLC d/b/a Payless Power, a retail electric provider, filed an objection at the Texas PUC to the electric broker registration filed by Payless Energy, LLC
Payless Energy, LLC's broker application had been first reported by EnergyChoiceMatters.com
Young Energy, LLC (YE) was granted authority by the PUCT to use the trade name Payless Power under its retail electric provider certificate in April 2010
"For over 13 years,
YE has used the name Payless Power to market and provide retail electric service to Texas consumers.
The company still utilizes the name to provide services and plans to continue using 'Payless Power'
in the future," Young Energy said
Young Energy further said that it also owns several federally registered trademarks for "Payless Power"
Young Energy alleged that the use of the Payless Energy name by Payless Energy, LLC in connection with electricity service would, among other things, violate PURA Chapter 17, which provides that electric customers are entitled to, "protection from fraudulent, unfair, misleading, deceptive, or
anticompetitive practices[.]"
Young Energy alleged, "The attempted broker registration by 'Payless Energy' would be misleading and deceptive to the public, the Commission, other brokers, and other REPs."
The broker registration statute makes brokers subject to the provisions of PURA Chapter 17, Young Energy said
Young Energy has also sent a cease and desist letter to Payless Energy, LLC concerning the use of the name Payless Energy
Young Energy said that, to the extent Payless Energy, LLC does not revise its registration to reflect a new name, the registration should be rejected by the PUC
