Texas PUC Affirms Notice Period To REPs Required For DCRF Rate Changes

The Texas PUC issued an order in Oncor's DCRF proceeding (56306) which adopted a proposal for decision from an ALJ which provided that retail electric providers are to be provided 45 days notice of approved rates under a DCRF proceeding

Notice of filed (proposed) rates is not sufficient notice to REPs, and the 45 days' notice to REPs cannot occur prior to a PUC order adopting approved rates. The PUC on May 16 approved new DCRF rates at Oncor, and Oncor provided notice to REPs that the new DCRF rates will be effective for bills rendered on and after July 1, 2024.

Separately, an ALJ in the DCRF proceeding of Texas-New Mexico Power (56428), proposed, in a proposal for decision adopting this precedent, that TNMP's new DCRF rates shall be effective on bills rendered on and after TNMP’s provision of 45 days’ notice to REPs of the "approved" rates

The ALJ would not require that the new DCRF rates be effective on the first day of the month following the provision of 45 days’ notice (meaning the effective date could be mid-month, depending on when the 45 days' notice is provided)
