Marketer To Pay $147,000 Under Settlement With Regulator's Staff

Arcadia Power, Inc. would pay $147,000 under a settlement with the Office of Education, Outreach, and Enforcement (EOE) of the Connecticut PURA to resolve allegations from EOE that had led PURA to open an investigation of Arcadia to, as stated by PURA, "review the operation of Arcadia, including its possible (1) operation as an electric supplier without a license, (2) operation as an aggregator without a certificate, (3) marketing to customers in a deceptive and misleading manner regarding the services it offered, (4) entering contracts with customers in a deceptive and misleading manner regarding the services it offered, and (4) [sic] failure to provide customers with services for which it charged."

Although the investigation was opened to address several various alleged operations, with respect to retail electricity aggregation, PURA had in 2017, in the form of an official directive from PURA's executive director, told Arcadia that Arcadia's stated business operations did not make the company, "an aggregator as defined by the law," and that Arcadia's stated business, "does not meet the definition of an electric aggregator..."
There has been no statutory change in the definition of aggregator since 2017
Arcadia's payment of $147,000 will be made to the electric distribution companies
indicated as a payment to reduce hardship customer arrearages
Additionally, the settlement provides that, "Arcadia shall not engage in any business in the state of Connecticut regarding
the sale of RECs, electric supply, or the representation of customers in securing an electric
supplier without securing the proper license or certification first."
"To the extent Arcadia has
engaged in any such business prior to the date of this Settlement Agreement, Arcadia shall
immediately cease such business and shall terminate any agreements with Connecticut
customers," the settlement provides
The settlement states, "This Settlement Agreement does not represent an admission or concession by
Arcadia as to the claims, or facts or circumstances surrounding the claims, or proper
disposition of any issue related to the [EOE] Correspondences or this Settlement Agreement."
