New York DPS Issues Notices of Apparent Violation To Three ESCOs

The New York Department of Public Service has issued separate Notices of Apparent Violation (NOAV) to three ESCOs, alleging that each has not made an annual compliance filing for 2024
Such separate NOAVs were issued separately to Ameripro Energy Corp.; Clear Green Energy LLC; and Relief Energy LLC.
The Uniform Business Practices (UBP), Section 2.D, requires each Energy Services Company (ESCO) to submit annually, by January 31st, a statement that the information and attachments in the ESCO’s Retail Access Application Form (RAAF) are still current and accurate. Alternatively, the ESCO shall provide a description of revisions to its RAAF as well as a copy of the revised portions or, at the ESCO’s option, a copy of the revised portions identifying the revisions by highlighting or other means.
The NOAVs alleged that each ESCO has failed to file the required update as of the March 4, 2024 date of the NOAVs
The NOAVs directed that each ESCO file by March 25 the required filing, or notice that the ESCO is withdrawing such ESCO's eligibility
The NOAVs alleged that DPS Staff contacted each ESCO with an email reminder, and again with an overdue notice, concerning the issue, but alleged that there has been no responsive filings from each respective ESCO
