CL&P today issued a correction stating that the inclusion of Direct Energy Business, LLC on CL&P's prior list of alleged non-paying suppliers was in error
CL&P has issued an updated list of suppliers alleged to have failed to pay the assessment (click here)
CL&P said, "The Connecticut Light and Power Company d/b/a Eversource Energy ('Eversource' or the 'Company')
hereby submits this update to its November 15, 2023 compliance with Order No. 4 of the July 26, 2023
Final Decision in the captioned docket (the 'Final Decision'). On November 15, 2023, in compliance with
Order No. 4, Eversource filed a worksheet as Attachment 1 detailing the payments received from each third-party electric supplier listed in Appendix C of the Final Decision in the captioned docket. The worksheet
also listed the third-party electric suppliers who failed to remit payment pursuant to Order No. 3 of the Final
Decision; specifically, the names of those parties appeared in red in Column A."
"Eversource hereby provides an updated version of Attachment 1 to its November 15, 2023 compliance
filing to reflect that Direct Energy Business, LLC ('DEB') remitted payment as of September 13, 2023.
The identification in Attachment 1 of the third-party electric suppliers who failed to remit payment pursuant
to Order No. 3 of the Final Decision has also been updated accordingly. Due to an administrative processing
issue between DEB and Eversource, receipt of this payment was not reflected in Eversource’s November
15, 2023 compliance filing," CL&P said
"The remainder of the compliance information in Eversource’s November 15, 2023 Motion and the relief
requested therein remains unchanged," CL&P said
Earlier:
Connecticut Light & Power filed a report with the Connecticut PURA alleging that nine retail suppliers have failed to pay required billing system upgrade costs previously ordered by PURA
The billing system upgrade costs were incurred as a result of, and assigned to suppliers as part of, Docket No. 14-07-19RE07, related to residential customer billing
While some of the suppliers who are alleged to have failed to pay CL&P have exited the market and have disputed the assessment before PURA, certain other suppliers alleged to have failed to pay CL&P appear to be currently active in the market. There may also be disputes concerning whether suppliers serving only incidental residential accounts should be assigned such costs.
Among other relief, CL&P suggested, "Based upon PURA’s authority and jurisdiction over the nine third-party electric suppliers
who failed to remit payment pursuant to Order No. 3 of the Final Decision, Eversource
requests that PURA initiate enforcement actions against these suppliers for failure to timely
comply with Order No. 3 in order to prompt the suppliers’ compliance and payment to
Eversource. Examples of steps PURA can take to enforce compliance include (a) issuing
notices of violation to assess civil penalties against the suppliers under Conn. Gen. Stat. §
16-41; (b) suspending the suppliers’ licenses pursuant to Conn. Gen. Stat. § 16-245(k); (c)
revoking the suppliers’ licenses pursuant to Conn. Gen. Stat. § 16-245(k); and (d) applying
the suppliers’ security on file with the Authority pursuant to Section § 16-245-4 of the
Regulations of Connecticut State Agencies to satisfy these outstanding obligations to the
extent possible."

Notably, CL&P proposed that any under-recovered amounts be collected via nonbypassable charge (net any amounts recovered in the future via the efforts noted above). CL&P is not proposing to re-assess other suppliers for the shortfall from the alleged non-payment
