Texas Retail Electric Provider Withdraws Request For Declaratory Order Concerning Levelizing Prepaid Customers Account Balance
The following story is brought free of charge to readers by VertexOne, the exclusive EDI provider of EnergyChoiceMatters.com
Pogo Energy filed with the Public Utility Commission of Texas to withdraw, without prejudice, its 2019 petition that had sought a declaratory order concerning the construction of Substantive Rule 25.498(a) as it relates to a proposed offering of a levelized payment option for prepaid service
In 2019, Pogo had said that it, "is in the process of developing a proposed service plan that customers could opt-into or opt-out of at any time, without restrictions, and would operate on a daily basis to level (or smooth) the impacts to a customer's prepaid account balance."
PUC Staff had opposed the sought order as inconsistent with the language of the current substantive rules

Staff response
Nothing substantive in the docket had been filed since February 2020, until the PUC's chief ALJ recently directed Pogo to indicate whether it still wished to proceed with the petition
