Texas PUC Staff Reports 40% Of Power Generation Companies & Self-Generators Have Not Filed Required Compliance Update

Staff of the Texas PUC reported that, as of July 12, 2023, 39% of existing power generation companies (PGCs) and self-generators registered with the Commission have
not filed a compliance update form which is required to be filed as a result of a recent rulemaking order in Project No. 52796
Approximately 280 PGCs and self-generators have not made the required filing
Specifically, as adopted in the recent rulemaking, 16 TAC § 25.109(a)(3)(A) requires existing power generation companies (PGCs) and self-generators to file a Commission approved form by June 1, 2023, to demonstrate compliance
with the rule.
Commission Staff emailed all regulatory contacts on file for PGCs and self-generators and emailed the Technical Advisory Committee listserv maintained by the Electric
Reliability Council of Texas to alert all existing PGCs and self-generators of the deadline to
file a compliance update form.
The PUC will provide PGCs and self-generators that have not filed an updated PGC or
self-generator registration form until August 18, 2023 to make the required filing
After August 18, 2023, noncompliance with 16 TAC
§ 25.109(a)(3)(A) will be referred to the Commission's Division of Compliance and
Enforcement for further investigation and potential enforcement action.
During today's open meeting, Staff noted that certain of the entities may no longer be in the market, but such entities have not notified the Commission of such (and were not previously required to do so)
Project No. 54941 was previously opened for PGCs and self-generators to file their compliance update
forms.
