Texas PUC Approves Settlement With REP Concerning POLR Eligibility Reporting

The Texas PUC approved a settlement between American PowerNet Management, LP (APM) and PUC Staff under which APM will pay $14,000 for alleged violations of 16 Texas Administrative Code (TAC) § 25.43(h)(1), related to retail electric provider eligibility to serve as a provider of last resort, and associated reporting requirements

The settlement states that APM, an Option 1 REP, "failed to provide information to the Commission necessary to establish its eligibility to serve as a POLR provider for the next term by July 10, 2022," as required.

As stated in the settlement, APM asserts it has taken or will take the following actions to prevent future violations of failure to provide required information or reports to the Commission from occurring:

a. As stated in the settlement, "APM declares that it has a computer-based compliance calendar that was to prevent missing certain compliance deadlines. APM's compliance calendar did not dispatch a "due date reminder" in this case. Upon investigation APM discovered that reminders are only dispatched for quarterly and annual compliance cycles. APM has modified its calendar reminders to allow for any frequency including biannual reporting as in this present case."

b. As stated in the settlement, "APM declares that it acted as promptly as possible to comply with the Commission's requirements however delays in compliance were encountered due to other business matters including compliance with other states. APM apologizes to the Commission for its failure to be more timely with its action."
