Staff Recommends Dismissal of Texas Solaro Energy REP Certificate Application due to Principal's Involvement in Prior Mass Transition

The PUCT has found the REP certificate application of Texas Solaro Energy LLC (9/8) >to be insufficient, but gave the company an opportunity to amend its application rather than dismissing it as Staff had suggested yesterday. Staff recommended dismissal because, in addition to other deficiencies, Staff noted that the sole representative listed on the application was Alonzo Williams II, Managing Director. Staff said that Williams was the President and CEO of Ideal Energy which defaulted and experienced a mass transition in 2006, and thus Staff said that Williams may not be used to meet the technical and managerial requirements for REP certification, per PUCT rule. As there were no other representatives listed on the application for the company, Staff recommended dismissal without prejudice, but an ALJ gave Texas Solaro Energy until September 29 to show compliance with the technical and managerial requirements and to cure the other deficiencies. The application will be dismissed without prejudice if the deficiencies are not cured by such time.
