Retail Gas Suppliers Seek 30 More Days to Conclude PGW Default Service Negotiations
Retail gas suppliers have requested an additional 30 day extension allow the parties investigating an alternative default service mechanism at Philadelphia Gas Works to, "conclude negotiations in this matter that are presently expected to result in the filing of a petition seeking approval of a settlement." Previously, suppliers had been directed to present their proposal, or state their intention to not pursue litigation of the matter, by September 12. RESA Seeks Rehearing of ComEd POR Uncollectibles Rate
The Retail Energy Supply Association has appealed to the Appellate Court of Illinois, First District, the Illinois Commerce Commission's order affirming a blended uncollectibles discount rate for Purchase of Receivables at Commonwealth Edison (8/19).
ERCOT Issues Invoices for Abacus Uplift
On September 21, ERCOT issued Default Uplift Invoices totaling $616,000 to QSEs and Congestion Revenue Right Account Holders per the methodology described in Protocol Section 9.19.1, to address the prior default of Abacus Resources Energy LLC. The total uplift amount represents the total short payments by Abacus for invoices due on February 25, March 3 and March 10, 2011, adjusted by credits applied by ERCOT to Abacus' obligation and by the remains of collateral held to pay final and true up invoices. Payment for Default Uplift Invoices is due on September 28. ERCOT will distribute the funds to previously short paid entities on September 29, 2011.
LCRA QSE to Pay $20,000 Regarding Failure to Meet Ancillary Obligations
Lower Colorado River Authority (QSE) would pay $20,000 to resolve PUCT Staff allegations that LCRA failed to adhere to ERCOT Protocol Sec. 6.3.2(2), concerning ancillary service provider obligations on February 26, 2008, in violation of PURA 39.151(j) and Subst. R. 25.503(f)(2). Staff alleged that LCRA did not deploy, in total, the Responsive Reserves, Up Regulation, and Non-Spin ancillary services it had agreed to provide to ERCOT.
ERCOT Names Three to Board
ERCOT has selected three new board members, subject to approval by the ERCOT members and the PUCT: Craven Crowell; Karl V. Pfirrmann; and Judy W. Walsh. Crowell is currently an independent director for the Texas Reliability Entity, and previously served as chair of the Tennessee Valley Authority. Pfirrmann is a former executive for PJM Interconnection, including terms as executive vice president and as interim president and CEO. Walsh is a former PUCT Commissioner and has served as chair of the audit and finance committee at Midwest ISO from 2005 to 2010 and as Western Electricity Coordinating Council from 2007 to 2010.
Migden-Ostrander Resigns from OCC
Janine Migden-Ostrander is resigning as Ohio Consumers' Counsel effective Oct. 15, 2011, stating that the current environment (a thinly veiled reference to cuts in the OCC's budget) makes serving in the manner required to fulfill the OCC's mission impossible. The Governing Board of the OCC named Bruce J. Weston interim Consumers' Counsel while members search for a permanent replacement. Weston has served as the agency's deputy consumers' counsel and legal director since August 2004.
