Texas Power to Pay $65,000 to Resolve PUCT Staff Compliance Audit

Texas Power L.P. would pay $65,000 under a settlement with PUCT Staff to resolve allegations that Texas Power was not in full compliance with 30 provisions of the Substantive Rules (39791).
The allegations resulted from a Staff compliance audit.
Specifically, Staff alleged that Texas Power was not in full compliance with the following:
- Subst. R. 25.475(f)(2)(A) relating to Terms of Service (TOS) document. Staff alleged that the TOS did not adequately describe all routine non-recurring TDU-related charges and a fee discrepancy between the TOS and disconnection notice
- Subst. R. 25.475(f)(8) relating to TOS document. Staff alleged that the TOS inaccurately stated the circumstances for which price change notifications would be provided
- Subst. R. 25.475(g)(2) relating to Electricity Facts Label (EFL). Staff alleged that the EFL did not disclose the actual prices(s) for electricity
- Subst. R. 25.479(c)(1)(I) relating to bill content. Staff alleged that the calculation of the average price paid for electricity excluded the monthly meter fee
- Subst. R. 25.479 (c)(1)Q) relating to bill content. Staff alleged that notification of actual price change was omitted
Prior to settlement, Texas Power corrected all of the alleged deficiencies.
