Acacia Energy to Pay $40,000 to Resolve PUCT Staff Compliance Audit

Acacia Energy Inc. would pay $40,000 under a settlement with PUCT Staff to resolve allegations that Acacia was not in full compliance with 23 provisions of the Substantive Rules (39767).
The allegations resulted from a Staff compliance audit.
Specifically, Staff alleged that Acacia was not in full compliance with the following:
- P.U.C. SUBST. R. 25.475(g)(2)(C), relating to pricing disclosures for the Electricity Facts Label (EFL). Staff alleged that Acacia's EFL did not reflect all recurring charges in the average prices listed.
- P.U.C. SUBST. R. 25.475(c)(2)(G), relating to general contracting requirements. Staff alleged that Acacia did not include a 12 month price history of the variable rate product on its website or indicate on its EFL where the information could be found.
- P.U.C. SUBST. R. 25.475(d)(2)(C), relating to pricing changes. Staff alleged that Acacia failed to include a required statement regarding how to obtain information on variable rate pricing.
- P.U.C. SUBST. R. 25.475(g)(2), relating to pricing disclosures for the EFL. Staff alleged that Acacia's EFL did not contain the required product term.
- P.U.C. SUBST. R. 25.475(g)(2)(F)(iii), relating to pricing disclosures for the EFL. Staff alleged that Acacia failed to include a required statement regarding the price of the product.
Prior to settlement, Acacia corrected all of the alleged deficiencies.
