Conn. Draft Would Grant License to AmericaWide Energy

Conn. Draft Would Conclude Sale of Sempra Energy Solutions Constituted Transfer of License
A draft Connecticut PURA decision would conclude that the sale of Sempra Energy Solutions by its parent companies to Noble Americas Gas & Power Corp., and the resulting name change of the licensee to Noble Americas Energy Solutions, LLC, constituted a "transfer of license" pursuant to Conn. Gen. Stat. Sec. 16-245(j), and thus prior PURA approval was required. The draft, if approved, is most notable for its precedential value as applicable to future supplier acquisitions, as Noble Americas Energy Solutions, though it originally believed a new electric license was not necessary, has subsequently sought a new supplier license under Docket 11-08-13. "Based on the fact that 100% interests of Sempra [Energy Solutions], the licensee, were be sold and that its name was changed as a result of the sale, the Authority determines that this sale and change in ownership constituted a 'transfer of license' pursuant to Conn. Gen. Stat. §16-245(j)," the draft would find. The draft would also hold that Noble Americas Energy Solutions is required to demonstrate its own financial, technical and managerial capability to continue to operate as an electric supplier, which will be addressed in Docket 11-08-13.
PURA Says Direct Energy Services "In Violation" of Conn. Gen. Stat. for Untimely Renewal
The Connecticut PURA said yesterday that Direct Energy Services, LLC, "has been in violation of Conn. Gen. Stat. §16-245, which prohibits any person from selling any electric generation services without a proper license," since June 7, 2011, when Direct Energy Services' license expired, according to PURA. The statement came in correspondence to Direct Energy Services, and was not a formal finding or conclusion of law. Direct Energy Services yesterday immediately filed a renewal application.
