Ontario Energy Board Accepts Assurances of Voluntary Compliance from Nine Suppliers

The Ontario Energy Board has accepted Assurances of Voluntary Compliance from nine retail energy suppliers, in response to the Board's recent notices that it intended to take enforcement action against 12 suppliers for various allegations of non-compliance with customer protection rules.
The Board accepted Assurances of Voluntary Compliance from Active Energy Inc./Active Energy Corp.; Ag Energy Co-operative Ltd.; Bullfrog Power Inc.; Canadian RiteRate Energy Corporation; Direct Energy Marketing Limited; Just Energy Ontario L.P.; morEnergy Savings Corp./Blue Power Distributed Energy Corp.; Planet Energy (Ontario) Corp.; and Superior Energy Management Electricity LP/Superior Energy Management Gas LP.
Under the Assurances of Voluntary Compliance, the suppliers agreed to pay various penalties that were generally $5,000 to $10,000 lower than the amounts originally sought by the Board. Suppliers also agreed to take various remedial actions to ensure compliance.

Two suppliers, Energhx Green Energy Corporation and Summitt Energy Management Inc. (of Canada), have requested a hearing on the Board's notice of intent, and those cases are now pending.
The Board did not indicate what action, if any, it would take with regard to MxEnergy Canada Ltd., which, to date, does not appear to have filed a request for hearing to contest the Board's earlier notice of intent, at least based on filings appearing on OEB's online docketing system.
As previously reported, the Ontario Energy Board stated its intent to make an order seeking revocation of MxEnergy Canada Ltd.'s retail gas supplier licence for what the Board alleged was failure to comply with the requirement to file a Certificate of Compliance with the Board certifying that MxEnergy is in compliance with the legal and regulatory requirements to carry on business in particular sales channels. MxEnergy was the only supplier among the 12 facing licence revocation.
