Stream Energy to Pay $74,000 to Settle PUCT Staff Compliance Audit

Stream SPE, LTD d/b/a Stream Energy Company would pay $74,000 under a settlement with PUCT Staff to resolve allegations that Stream was not in full compliance with 29 provisions of the Substantive Rules (39696).
The allegations resulted from a Staff compliance audit.
Specifically, Staff alleged that Stream was not in full compliance with the following:
- P.U.C. SUBST. R. 25.474(d)(5)(I) relating to required authorization disclosure. Staff alleged that the required disclosure regarding the three-day right of recession was incomplete.
- P.U.C. SUBST. R. 25.474(e)(5)(D) relating to required authorization disclosure. Staff alleged that the required disclosure regarding pricing disclosure was incomplete.
- P.U.C. SUBST. R. 25.475(g)(2)(D)(i) relating to electricity facts label. Staff alleged that complete average kWh price for each tier was not disclosed.
- P.U.C. SUBST. R. 25.475(g)(2)(F)(iii) relating to electricity facts label. Staff alleged that the prescribed text was not verbatim.
- P.U.C. SUBST. R. 25.485(b)(4) relating to customer access and complaint handling. Staff alleged that the company did not have capability to accept customers' right of rescission 24 hours a day by telephone.
Prior to settlement, Stream corrected all of the alleged deficiencies.
