PUCT Abates TexRep6 Revocation Proceeding to Allow Additional Time to Show Compliance

The PUCT abated until the September 15 open meeting consideration of revocation of TexRep6, LLC's REP certificate, for failure to comply with provisions of the new certification requirements of Subst. R. 25.107 for several months after the compliance deadline (Docket 38732).

TexRep6 was previously purchased by IC&T Americas, LLC, which is now known as Smartcom Energy Technologies, LLC.

As only noted in Matters, a proposed order would revoke TexRep6's certificate (see 6/17).

While TexRep6 is now in compliance with the financial requirements, there is nothing in the record showing continuing compliance with the 15-year industry experience requirement. TexRep6 said that it has recently hired additional personnel to meet this requirement, and the abatement will allow Staff to review documentation of such hires, as well as holistically reviewing TexRep6's compliance with all certification requirements.

Commissioner Kenneth Anderson, expressing frustration with the time it has taken for TexRep6 to come into compliance, said that "one hiccup and the guillotine falls." Anderson stressed that should the Commission decline to revoke TexRep6's certificate, it should not be seen as the Commission being soft on companies which do not meet the certification standards.
