Calif. ALJ Orders Status Report on Phase In of New Direct Access

A California ALJ has granted a motion from several direct access parties, and directed the Energy Division to file a status report on the implementation of the direct access phase-in process (R. 07-05-025).

As first reported by Matters, the Alliance for Retail Energy Markets, Retail Energy Supply Association, and Direct Access Customer Coalition sought a report regarding the Phase 2 and Phase 3 Notice of Intent periods (4/21).

The ALJ directed the PUC's Energy Division to produce an updated status report providing, for each utility for Phase 2 (service starting January 2011) and Phase 3 (service starting January 2012), the number of customers submitting accepted six month switching notices, the load associated with those submissions, the number of customers submitting six-month switching notices that were rejected, and confirmation of the amount of time it took to fill the cap.

The report shall also provide information about the completion of the processing of enrollments of new direct access customers for 2011 under Phase 2.

The report shall be filed by July 15, 2011.

The ALJ denied the request of Commercial Energy of California to include data related to direct access customers who have returned to utility service, which had not been included in a prior status report.
