AllStar Energy, PUCT Staff Reach Second Settlement in Revocation Proceeding

TexRep5, LLC d/b/a AllStar Energy and PUCT Staff have reached a settlement in principle that would resolve an outstanding petition from Staff to revoke AllStar Energy's REP certificate (Docket 37801 et. al.).

The agreement has not yet been signed by all parties, and Staff and AllStar Energy asked that the case be abated pending such finalization of the agreement.

Details of the settlement were not disclosed.

Staff and AllStar Energy had previously reached a stipulation in the case, but that settlement was rejected by the Commission, which sent the case back to the State Office of Administrative Hearings.

As previously reported, the proceeding concerns AllStar's license amendment to correct its listed ownership to the George Corporation, instead of Horizon Power & Light, and its failure to disclose on its application a Delaware PSC investigation into Horizon which resulted in a civil penalty and under which Horizon agreed to relinquish its license. Staff had sought certificate revocation based on the failure to adequately disclose the Horizon proceeding.

Although AllStar and Horizon are legally separate companies, they share several principals, including Neil Leibman and Tom O'Leary.
