ERCOT Suspends Several State Estimator Load Reports on Confidentiality Claim

ERCOT has suspended several State Estimator Load Report postings on the Market Information System (MIS) as of March 30, 2011, at 09:00 due to specific claims of confidentiality raised by members of Texas Industrial Energy Consumers (TIEC).

Suspended reports include:

- NP6-620-CD: State Estimator 15-minute Average of Loads

- NP6-621-CD: State Estimator Load Report - Individual Load on Electrical Buses

- NP6-623-CD: State Estimator Load Report - Load by Electrical Bus by Load Zone

- NP6-624-CD: State Estimator Load Report - Total System Load on Electrical Buses

ERCOT does not intend to resume posting these reports until all confidentiality issues have been resolved. ERCOT had been posting the reports to meet Protocol Sections 6.5.7.1.13(4)(b) and (e).

In a letter to ERCOT, TIEC said that the State Estimator Load Report - Load by Electrical Bus by Load Zone and State Estimator Load Report - Total System Load on Electrical Buses were posting the load on electrical buses that serve individual retail customers in five minute intervals to the MIS Secure Area. "The buses and substations are also labeled in the report in a way that clearly reveals the identity of the associated customer," TIEC said.

While the information posted was similar to the information that was redacted for Private Use Networks under NPRR 202, the State Estimator Load Reports relate to individual industrial loads rather than only Private Use Networks. "Through the information contained in these reports, competitors and suppliers of TIEC members can discern competitively sensitive information about a site's electric consumption in close to real time, and could use that information in a manner that would cause competitive injuries to TIEC members," TIEC said.

TIEC argued that the relevant information contained in the reports is protected from disclosure under P.U.C. Subst. R. 25.361(e), and P.U.C. Subst. R. 25.505(f)(E)(iii), and PURA Section 39.901.
