Gateway Power Services to Pay $17,000 to Resolve Findings from PUCT Staff Compliance Audit

Gateway Power Services would pay $17,000 under a settlement with PUCT Staff to resolve Staff's allegations that Gateway was not in compliance with 13 provisions of the Substantive Rules (39265).

Staff's allegations resulted from a compliance audit.

Among other things, Staff alleged Gateway was not in compliance with the following:

- PUC Subst. R. 25.475(g)(2)(a), relating to electricity facts label (EFL) regarding pricing disclosures. Staff alleged that the company's EFL did not accurately reflect the total average price for each prescribed kWh for its fixed rate product

- PUC Subst. R. 25.475(g)(2)(F)(iii), relating to EFL and pricing disclosures. Staff alleged that the company's EFL failed to contain a portion of the required notice regarding pricing

- PUC Subst. R. 25.474(d)(11)(A), relating to enrollment via the internet. Staff alleged that the company did not provide all rescission information on the notice of confirmation of enrollment

- PUC Subst. R. 25.475(e)(1)(C)(vi) regarding contract expiration. Staff alleged that the expiration notice did not reference an EFL to provide information regarding its default product

Prior to settlement, Gateway corrected all of the alleged deficiencies.
