Epcot Electric to Pay $40,000 to Resolve Findings from PUCT Staff Compliance Audit

Epcot Electric (TexRep1, LLC) would pay $40,000 under a settlement with PUCT Staff to resolve Staff's allegations that Epcot Electric was not in compliance with 28 provisions of the Substantive Rules (39249).
Staff's allegations resulted from a compliance audit.
Among other things, Staff alleged that Epcot Electric was not in compliance with the following:
• PUC Subst. R. 25.475(g)(2)(F)(iii), relating to Electricity Facts Label and pricing disclosures. Staff alleged that Epcot's EFL failed to contain a required notice regarding pricing
• PUC Subst. R. 25.478(e), regarding amount of deposits. Staff alleged that Epcot exceeded the limit for some deposits as outlined in the rule.
• PUC Subst. R. 25.474(d)(5)(F), relating to required authorization disclosures. Staff alleged that Epcot's internet enrollment process did not mention early termination fees or applicable amounts
• PUC Subst. R. 25.474(d)(5)(I), relating to required authorization disclosures. Staff alleged that Epcot's website did not disclose the right of rescission for switch requests.
• PUC Subst. R. 25.475(c)(2)(G), relating to general contracting requirements. Staff alleged that Epcot's website did not identify required historical disclosures regarding variable rate products
• PUC Subst. R. 25.475(f)(2)(A), relating to Terms of Service and pricing and payment arrangements. Staff alleged that Epcot's TOS failed to include a routine non-recurring charge that could be charged to the customer
Prior to settlement, Epcot Electric corrected all of the alleged deficiencies.
