Md. PSC Sets Hearing on Price to Compare Calculation
The Maryland PSC has scheduled
a hearing for March 29 on the Office of People's Counsel petition for modifications
to the utility SOS Price to Compare calculation process (Case 9228). OPC's petition
was exclusively reported by Matters (2/11). In its petition, OPC alleges that Pepco,
Delmarva, and Allegheny are not using the most recent prices in the weighted average
SOS price, and is seeking a modification to what prices are included in the weighted
average during the April and May period when rates for three SOS pricing periods
are known (but only two are included in the weighted average). Utilities were instructed
to answer OPC's petition by March 7, and other stakeholders may comment on the petition
by that date as well.
MJSA Endorses Constellation Energy As Supplier
Constellation Energy has been named
as the endorsed energy supplier by MJSA (Manufacturing Jewelers & Suppliers of America),
the national, 1,500-member trade association for jewelry makers, designers, and related
suppliers, based in Attleboro Falls, Massachusetts.
Constellation Acquiring Solar Project from Community Energy
Constellation Energy has
agreed to acquire a 7.8 MW DC solar generation project located in Vineland, New Jersey
from Community Energy Solar, LLC. Output will be sold to the Vineland Municipal
Electric Utility under a 25-year power purchase agreement obtained by Community Energy
and assigned to Constellation Energy. Constellation Energy will finance as well
as build, own, and operate the solar installation. The project is expected to generate
approximately 10 million kilowatt-hours of electricity per year.
FERC Denies 60-Day Answer Period for P3 RPM Complaint
FERC declined to provide an
additional 60 days for answers to the complaint filed by PJM Power Providers Group
regarding the current Minimum Offer Price Rule in the Reliability Pricing Model,
but did extend the comment date until March 4, 2011, which is the same date previously
set for comments on PJM's separately filed tariff changes on the Minimum Offer Price
Rule (see 2/14). Separately, the Maryland PSC asked that the two dockets be consolidated
(EL11-20 & ER11-2875), and that paper hearing proceedings be initiated. "Disputes
over complex technical matters such as market design cannot be disposed of on the
basis of preliminary pleadings alone ... Without the benefit of a careful stakeholder
review, PJM's proposal is vulnerable to costly mistakes and unforeseen consequences
that cannot be easily unwound," the PSC said. "Setting aside the invalidity of P3's
claims - claims that are premised wholly on the implausible and unsubstantiated theory
that state regulators are conspiring to unlawfully manipulate the RPM for the purpose
of suppressing prices below a just and reasonable level - these changes, if implemented,
will create formidable and discriminatory barriers for any new entrant into PJM's
capacity market and preserve the status quo to unjustly benefit incumbent capacity
suppliers by creating in each auction a new de facto price floor at the administratively
determined net cost of new entry for a combustion turbine generator," the PSC said.
