Md. Hearing Examiner Finds Timing of Allegheny Warrior Run Reactive Power Filing
Prudent
A proposed order from a Maryland hearing examiner would find that Allegheny
Power, acted in a reasonable and prudent manner regarding the offering of reactive
power from the Warrior Run cogeneration facility (which continues to produce stranded
costs), and that no penalty or credit to ratepayers should be directed with respect
to its FERC reactive power filing effective July 1, 2008 rather than January 1, 2008.
The Office of People's Counsel has argued that Allegheny's failure to ensure that
reactive power revenues were available January 1, 2008 (the first date such revenues
were available under a change in treatment of the Warrior Run output under which
the output is directly sold into the PJM market) violated the 1999 settlement which
requires Allegheny to maximize the output of the plant. The hearing examiner agreed
with Allegheny and Staff that Allegheny took prudent steps to file the reactive power
tariff at FERC as soon as practicable (Case 8797).
