Conn. Draft Would Establish Alternative Compliance Payment Totals for Several Suppliers

A draft Connecticut DPUC decision would establish alternative compliance payment
amounts to be paid by Dominion Retail, Glacial Energy, Integrys Energy Services,
MXenergy, Public Power LLC, and TransCanada Power Marketing in connection with a
shortfall in RECs used to meet the RPS requirements for the year 2008 (Docket 09-
The DPUC's findings are preliminary, and in prior years, the draft RPS findings have been substantially revised due to load adjustments or other factors.
However, under the draft calculations, the DPUC would assess alternative compliance payments in the following amounts:
The draft notes that these suppliers may have already effected the compliance payment
to the appropriate parties (the Renewable Energy Investment Fund or Conservation
& Load Management Fund), and the draft would direct the REI Fund and the C&LM Fund
to refund any excess payments made by the suppliers once the final compliance totals
are established.
The DPUC noted that there is no data in the record to determine the reasons for the suppliers' deficiencies. The Department believes, however, that in most cases, the deficiency is the result of load adjustments.
In future annual RPS compliance filings, load serving entities will be requested to provide information relating to their deficiencies in order for the Department to better analyze the REC market and monitor the success of the Connecticut RPS, the draft holds.
Of 17 competitive suppliers serving load in 2008, some 13 acquired a surplus of RECs in at least one RPS class (including some suppliers who were deficient in another class and would pay an alternative compliance payment).
In most cases, based on interrogatory responses, the DPUC said that the surplus RECs were purchased to protect the supplier against any load adjustments.
The draft decision, which can be found here, lists the number of RECs in each class that each supplier and utility procured for 2008. The draft also contains summary data concerning the location of Class I and II generators and fuel source data, though the utility of such data is limited due to its age, and will not be excerpted here.
