OPC Withdraws Opposition to Maryland Gas & Electric Trade Name
The Maryland Office
of People's Counsel has withdrawn opposition to the electric supplier license application
of Energy Services Providers, Inc. d/b/a Maryland Gas & Electric, after parent U.S.
Gas & Electric Inc. answered OPC's concerns about U.S. Gas & Electric Inc., a legally
distinct entity, also using the trade name Maryland Gas & Electric for its retail
natural gas marketing. Specifically, Maryland residential contracts executed by
the companies shall state that the services will be provided by either "Energy Services
Providers, Inc. d/b/a Maryland Gas & Electric" or "U.S. Gas & Electric, Inc. d/b/a
Maryland Gas & Electric." OPC said that a, "residential consumer is entitled to
know the formal corporate identity of that party legally responsible for providing
the services under the contract," and that the arrangement described above answers
this concern. The Maryland PSC is to consider Energy Services Providers, Inc.'s
application at today's administrative meeting.

Wind Generators Appeal Denial of Exemptions from Protocol 5.9.1.3 Frequency Response
Requirements
Several Texas wind generators have filed an appeal and complaint at the
PUCT (Docket 39034) against ERCOT due to ERCOT's denial of exemptions from ERCOT
Protocol 5.9.1.3 sought by the generators. Protocol 5.9.1.3 enacted provisions of
Protocol Revision Request 833, which placed primary frequency response requirements
on existing wind generation resources. Protocol 5.9.1.3 allows for an exemption,
to be determined in ERCOT's "sole discretion," where compliance would be technically
infeasible. The wind generators' complaint alleges that ERCOT is relying on a technical
feasibility standard which was not included in PRR 833.

The Michigan PSC released data which it
said shows that the state's utilities are "on track " to meet renewable energy compliance
goals. The Commission reported that 3.63 percent of Michigan's electricity was produced
by renewable sources in 2009, which the PSC said is, "consistent with what Michigan's
electric utilities' plans are for ramping up to reach the 10 percent goal" Alternative
electric supplier data was not included in the PSC's report.
