Md. PSC Fines Affinity Energy Management, Grants Broker License
The Maryland PSC declined
to adjust Staff's recommended penalty and fined Affinity Energy Management, LLC $22,500
for operating as a broker in the state without the requisite license. The PSC also
granted Affinity Energy Management an electric broker license to serve all customer
classes. Affinity Energy Management had been seeking a reduction in the amount of
the fine, calling Staff's proposed amount punitive in light of the typical fine of
$100 or the equivalent of the Commission assessment the broker would have paid had
it been licensed (see 11/4). Staff's penalty amount is based on a fine of $25 per
day of operations prior to licensure, as Staff argued that a higher fine is appropriate
given Affinity Energy Management's continued brokering even after it became aware
of the licensing requirement. Staff noted that, had the Commission followed the
penalty precedent in the most similar case where a broker continued serving customers
after being made aware of the licensing requirement (where the Commission ordered
forfeiture of all Maryland revenues), the fine for Affinity Energy Management would
have been in the six figures.
