FirstEnergy Solutions Not Signing Opt-Out Aggregation Agreements Until PUC Matter Resolved
FirstEnergy Solutions confirmed this morning that it is not signing any opt-out municipal aggregation contracts with Pennsylvania home rule municipalities until the PUC resolves the legal questions of such aggregations.  FirstEnergy Solutions’ decision not to sign any opt-out aggregation contracts pending clarity from the Pennsylvania PUC was first reported by The Progress (Clearfield, Pa.).  Two declaratory petitions have been brought by retail suppliers asking that the PUC declare home rule opt-out aggregations to be illegal absent enabling state legislation (11/4).  According to The Progress, the City of Dubois, one of the cities considering an opt-out aggregation to be supplied by FirstEnergy Solutions, has still directed its city solicitor to draft an opt-out aggregation ordinance, though the city has elected to wait for a PUC decision before final action.

Shelk: Lack of Penalty in FERC Audit of Entergy Disturbing in Light of Other Cases
EPSA President and CEO John Shelk said it in a statement yesterday that it was disturbing that a FERC audit, which Shelk claimed found numerous "serious violations" of Entergy's OATT, did not result in any penalties from the federal Commission in light of the fines levied on other companies for smaller infractions.  "Disturbingly, in spite of numerous serious violations of Entergy's own OATT found in the recent audit, FERC did not assess a single fine or otherwise impose a penalty when it has not hesitated to do so for lesser violations by others," Shelk said.
