Penstar Power, L.L.C. would pay an administrative
penalty of $6,000 under a settlement with PUCT Staff to resolve a Staff investigation
concerning Penstar's compliance with P.U.C. Subst. R. 25.474, concerning selection
of a retail provider and P.U.C. Subst. R. 25.480, concerning bill payment requirements
(Docket 38783).
The investigation was prompted by a complaint.
A proposed finding of fact in the settlement states that Penstar was not in compliance
with Subst. R. 25.474(h)(5)(A) because the company was unable to provide verification
that an electronic recording of the applicant's verification had been obtained; and
